Family mediation is a means by which separating or divorcing couples can reach an agreement between themselves privately, confidentially and informally. It is designed to help couples create their own solutions to resolve conflict by exploring alternative solutions – possibly resulting in a settlement without extensive litigation.

The mediation process begins either with a court order or with an agreement by both parties. If there is a history of domestic violence or abuse, the court may not refer parties to mediation. A professional mediator uses his or her skills to assist both parties by clarifying and defining issues, providing information and suggestion compromises.

In mediation, couples retain their attorneys because, although some mediators are attorneys, the mediator is not authorized to give legal advice. The mediator’s focus is on helping the parties reach their own agreement. Lawyers experienced in marriage dissolution need to be engaged to ensure each party is aware of their respective legal rights and that any agreements reached are based on informed decisions.

Mediation is different than arbitration. In arbitration, the parties agree to be bound by the decision of the arbitrator. In mediation, couples do not agree to be bound by anything, and if talks break down they can proceed to litigation. In the traditional system, the decisions of the divorcing couple are made by attorneys. If negotiation fails, the case goes to court and a judge makes the decisions. This process often leads to hostility among family members and is more expensive and time consuming than mediation. Also, post-divorce litigation is less likely when the couple has created its own solution to the situation.

Once the mediation process ends, the mediation sends a Memorandum of Agreement to each spouse’s attorney. The attorneys will then use the terms of the memorandum to draft a settlement agreement and file it with the court.

Mediation is valuable in post-divorce conflicts including the modification of alimony, child support and visitation to meet these changing needs.
